POLICY REGARDING PHOTOGRAPHIC COLLECTIONS
I. GENERAL
The Archives resources,
including the photographic collections, are held in public trust and intended
for educational use of the general public. The only objective more important
than their proper use is their preservation.
II. ACCESS
The Archives agrees
to provide access to its collections for researchers, students, journalists,
and hobbyists under the following conditions:
- Archives, by
their nature, have limited access. This means that, because the contents of
the collections may be unique or rare, special constraints such as "limited
hours" and "in-house use only" will apply. Persons wishing
to access the collections should contact the archives in advance to confirm
hours of availability. Requests
for access may be made to the archivist, Laura Jacobs, in person, by email,
or by telephone at (715) 394-8359 or (715) 394-8343.
- Patrons will
be required to read procedural rules and sign an agreement prior to using
the resources.
- No materials
may be removed from the premises. Loan of original photographs will not be
permitted, but copy prints may be prepared upon request. Specific rules apply
to reproduction (see below).
- Storage area
is restricted to staff only. Archives staff will retrieve and refile all research
materials requested by users.
- Users are responsible
for maintaining vertical files in proper condition and original order, with
photographs right side up, facing forward, smaller photographs at the front,
and contents neatly arranged within the folder. Books within the collection
shall also be handled with care, and staff must be consulted before photocopies
may be made. Users who are unwilling to meet these requirements will be asked
to terminate their research.
III. REPRODUCTIONS
-- Copyright and Restrictions on Copying
- Patrons who
wish copies of images from the Archives collections may arrange duplication
at the convenience of the staff. Everyone requesting photographic copies must
fill out a Reproduction Agreement Form before any copies are made. Researchers
do not have the right to make any additional copies of the image or publish/re-use
it in any manner without further permission.
- Making a copy
does not constitute permission to use that copy for any purpose other than
the patron's own research. Many resources are protected by copyright. Although
the Archives may physically own a photograph or other material, it may not
necessarily own the rights to allow the item to be reproduced. Unless the
Archives has been specifically given copyright, the copyright for an image
is the property of the person or heirs of the person who created the material.
Additionally, a donor may give a photograph but may not own the copyright
to that image (as is the case with many photographic donations). Researchers
assume full responsibility for conforming to the laws of libel, privacy and
copyright that may be involved with the use of materials. This includes, in
some cases, procuring written permission from the copyright holder
before reproductions will be made. Staff maintain the right to refuse reproduction
requests if copyright clearance is not presented. Staff may be able to supply
contact information to copyright holders in some cases.
- Patrons are
not permitted to make copy negatives of photographs from the Collections.
Photographs, provided they are not restricted, may be reproduced in print
form for personal, business, or publication use. Standard production time
will be two weeks, dependent on the scope of the order. Orders for photographic
services must be submitted in writing, with checks payable to UW-Superior
Archives.
- Except for
slide transparencies and video shots, patrons normally are not allowed to
make their own photographic or digital copies of materials. If, under special
circumstances, the user is allowed to make such a copy, the user must return
all copies to the archives.
- Researchers
may videotape images for research purposes provided that the images are handled
in accordance with the guidelines above. Users may not tape or otherwise physically
attach original materials to any surface to facilitate videotaping. Patrons
who do their own videotaping must pay the same fees per image as a print would
cost. Videotaped materials may not be used for any purpose other than research
without requesting permission to use or publish such as is outlined above.
- Researchers
who have been given special permission to do their own scanning must pay the
same fees per scan as for a print copy. Researchers who do their own scanning
do not have permission to use the scanned images for any purpose other than
personal research without requesting permission to use or publish as is outlined
above.
- Other than
standard cropping and resizing, images may not be altered.
IV. REPRODUCTION
FEES*
Due
to recent cost increases, the rates for reproductions have changed.
Staff may arrange for copies of black and white or color photographs at the
following rates, not including shipping and handling charges or use fees:

Base cost of photographic
reprints are listed below. Prices are subject to change at any time. Base cost
refers to Black
& White reproduction -- Color reprints may be somewhat more expensive.

$13.00 (b&w)
- 8 x 10 prints
$17.00 (b&w; color variable)
If no negative
exists, a digital scan will be created. Researchers will
be charged for scans.
Slide duplicates
are no longer available.
Plain paper copies
of maps and ship plans (basic rate) is $1.75 per square foot. Color reproduction
of maps and plans is not available. Standard reproduction time will be 3 weeks.
V. USE FEES AND
SCHOLARLY CREDIT*
Use fees apply
to the reproduction in any format (print, film, video or digital),
one time use only; no other rights are implied. Requests for publication, reuse,
or changes in use must be submitted in writing to the Archives. The following
use fees will be assessed in addition to copy costs:

RESOURCES FROM THE COLLECTION MUST RECEIVE PROPER SCHOLARLY CREDIT.
